These terms cover your use of EmailFig: the app, the sending infrastructure, and everything at emailfig.com. We've kept them as short as a binding agreement lets us.
The agreement
By creating an account or using the service, you agree to these terms with EmailFig ("EmailFig," "we," "us"). If you use EmailFig on behalf of an organization, you represent that you have authority to bind that organization, and "you" means the organization. If you don't agree with these terms, don't use the service. No hard feelings.
Your account
You're responsible for your account and everything that happens under it. Keep your credentials secure, and let us know at contact@emailfig.com the moment you suspect unauthorized access. You must be at least 16 years old and provide accurate information when you sign up.
Acceptable use
EmailFig exists to send email people want. You agree to send only to recipients who have given you permission, to honor unsubscribes immediately, and to comply with applicable law, including CASL, CAN-SPAM, and the GDPR where they apply to you. You also agree to our Acceptable Use Policy, which sets out exactly what's prohibited and how we enforce it, and which is part of this agreement by reference. You also agree not to probe, disrupt, or overload the service or other people's use of it.
We may suspend or terminate accounts that put deliverability at risk for everyone else. Where practical we'll warn you first; for clear-cut abuse we won't.
Your content
You retain all rights to the content you create and the subscriber lists you upload. You grant us the limited license we need to operate the service: storing, processing, and transmitting your content to deliver your email. We don't sell your data, and we don't use your lists for anything except your sending. How we handle personal data is described in our Privacy Policy; if you or your subscribers are in the EU or UK, see our GDPR page for how that data is protected.
Billing
Paid plans are billed in advance, monthly or annually, based on your plan tier and subscriber count. If your list grows past your tier we'll tell you before we change what you pay. Fees are non-refundable except where these terms or the law say otherwise. We can change prices with at least 30 days' notice; changes apply from your next billing cycle, never retroactively.
Cancellation
You can cancel any time from your account settings: no email required, no retention call. Your account stays active through the end of the period you've paid for. You can export your subscriber lists and campaign data at any time, before or after cancelling; we keep your data for 30 days after your account closes, then delete it.
Warranties & liability
The service is provided "as is." We don't promise it will be uninterrupted or error-free, and we can't guarantee inbox placement; nobody honestly can. To the maximum extent permitted by law, our total liability for any claim arising out of these terms is limited to the amount you paid us in the twelve months before the claim, and neither of us is liable to the other for indirect or consequential damages.
Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
Governing law & disputes
EmailFig is based in Canada, and these terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, without regard to conflict-of-law rules. Any dispute arising out of these terms or your use of the service will be brought in the courts located in Ontario, Canada, and you consent to their jurisdiction. This section governs the agreement itself; it doesn't change the data protection rights described in our Privacy Policy and GDPR page, which apply according to your own location.
Changes to these terms
We may update these terms as the product and the law evolve. For material changes we'll email the address on your account at least 30 days before the new terms take effect, and the dates at the top of this page will always tell you what you're reading. Continuing to use the service after a change takes effect means you accept it.
